Alleged rapist to be retried in Abu Dhabi

The UAE’s top court has ordered a retrial of a man accused of raping a woman inside his car after he was sentenced to three years in prison on the grounds there is not sufficient evidence in the case, the press reported on Tuesday.

A Court of First Instance had sentenced the man to three months in prison for having sex with the woman in his car but an appeals court ordered him jailed for three years after he was convicted of raping her, the papers said.

The new sentence prompted the defendant to appeal with the Federal Supreme Court which ordered a retrial for lack of evidence after contradicting statements between the woman and her maid, who said she saw her employer going to into the defendant’s car.

“The maid said she did not see the defendant using force to get the woman into his car,” Arabic language daily Emarat Al Youm said.

Earlier the prosecutor demanded tough punishment of the defendant, accusing him of forcing the woman into his car and taking her to an isolated area before raping her. The defendant denied such charges, according to the paper, which did not identify both or mention where the case took place.
