'CID officer' on trial for assaulting student in car

A jobless man allegedly impersonated a CID officer and stopped a girl while she was in a car with her friend and later threatened the girl with scandalising their relationship and later forced her to get into his car where he abused her sexually, the Dubai Criminal Court heard.

AMG, 26, Emirati, is also accused of confining the 19-year-old victim, AMR, in his car and threatening to tell her parents that she had gone out with another man to force her submit to his sexual desire.

The victim, an Egyptian university student who was born in the UAE and stayed with her mother, grandmother and sister in Dubai, had gone to visit her friend in the university’s accommodation on January 2 in the afternoon.

“I called my friend FAM, a university student whom I had known for five months, at around 4pm and told him that I am in the university and if we could meet at Matajer near the University City in Sharjah.

“He agreed and so I went in my car there and got into FAM’s car. We headed to Mueileh area to buy some tea from a cafeteria. As we were waiting in the car in front of the cafeteria, a car stopped next to us and a man asked my friend to open the window. He claimed he is a CID without presenting any ID and said he saw us at Matajer and asked why we are together.

“FAM told him that we are friends and that we came here to have some tea. He said he will notify the police that we are together and held his mobile to call the police. FAM and I got out of the car to ask him not to call the police. The ‘CID’ asked FAM to drop me back to my car immediately if we did not want a scandal.

“FAM dropped me back and I drove my car to Dubai. On the way, I was talking to FAM over the phone as I was scared about the incident. As I neared Ittihad Road before Al Mulla Plaza, I noticed that the ‘CID’ was behind me and asking me to stop. I told FAM on phone that I will stop to find out what he wants and so I hung up the phone. I winded down the glass and as the traffic was slow, he asked me to stop at the nearest parking, “ AMR testified.

The ‘policeman’ stopped near her car at Al Mamzar Mall, got out of his car and told her that he wants to note down her statement.

“The ‘policeman’ asked me to show my driving licence and the car’s registration. I showed them to him. The car was in my mother’s name.  He pretended to be checking with the police about the car over the phone, telling that he is with me in the car to take my statement.

“He then asked me about my relation with FAM. I told him we are just friends and that I did not do anything wrong with him. He then told me that FAM had confessed about our relationship and that he had sex with me. As I had never done anything wrong, I confidently told him that this is not true. When he said that police had been watching me and FAM for two weeks, I told him that the last time I met FAM was a month ago. He asked me to move as I had parked my car in a wrong place. I moved my car and he asked me to stop at the parking in front of the Canadian Hospital.

“He again asked me about my relation with FAM and about my mother’s name and if I have sisters. As I sensed that he is hinting at scandalising the issue, I asked him not to. He promised not to. I asked him to finish the matter because my mother was waiting for me at home. He asked me to drop him back to his car which I did.

“FAM was calling me repeatedly during the ten minutes that I was with the ‘policeman’ in the car. I could not answer his calls as he took the mobile from me and put it away.  When I reached his car, he asked me to accompany him in his car to continue taking my statement. I asked him to do that in my car but he insisted, threatening to cause a scandal if I did not.

“I tried to inform my friend over the BlackBerry phone while sitting on the front seat of his car but when he saw me, he snatched the phone from me and locked his car’s doors. I got scared and told him that I want to return home. He insisted that I sit on the front seat and sign on the papers.

“Now I had a suspicion that he was not a policeman and got very scared and started crying and begging him to let me go home. He asked me to stop crying or “you will see what I will do with you”. I did not understand what he meant.… He insisted that I move to the back seat He sat next to me and started kissing me and groping my body

“I was crying and pushing him away from me, begging him to let me go. He was threatening me of a scandal if I did not submit to him. He told me that I not a virgin which I denied. He forced to lie on my belly and sodomised me for about 15 minutes ,  after which he cleaned my body and asked me to put on my dress, asking me not to tell anyone of what had happened, including my friend FAM. He also said that he will be my boyfriend and that I should answer his calls. Then sent a missed car to his mobile from mine to get my number,” the victim testified.

It was around 5.45pm when the girl left his car and called her friend to tell him what had happened. Her friend called his brother who works for the police and told him about the incident. The latter asked him to report the crime to the police immediately.

The girl told her sister and mother about the incident and they all came and reported to the Murraqqabat police station at around 8pm.

The bogus policeman called the victim several times but she did not answer his calls. Police asked her to return his calls and to ask him to meet her in the Abu Hail area. “I did that and was surprised to know that he already knew that she had reported the incident to the police. He said he will come to the police station immediately but he did not,” the victim testified.

Police reached to the accused’s house in Al Quoz and arrested him at around 3am.

The victim recognised the accused when shown to her in an identification parade.

Her friend FAM, 22, Emirati student, repeated the same testimony saying that he came to meet her at the parking near Al Bustan Centre. When she called him she was crying and he did not understand what she was saying except that the ‘policeman’  had molested her.

“When I arrived about half an hour after receiving her call, she was in a very bad condition. I bought her some water and asked her to calm down as I tried to understand what happened. Then I called my brother who is a CID officer. My brother asked me to report to the police immediately which she did accompanied by her mother and sister,” FAM testified.

“After some time I received a call from Murraqqabat police station where I went and identified the accused when shown in an identification parade,” the victim testified.

The accused denied sodomising the victim and claimed he saw her in front of Century Mall and that she picked his mobile number which he  wrote on a piece of paper and threw it to her in the parking.

“I saw her in the mirror picking up the piece of paper I threw in the parking,” he claimed.

Forensic reported that sperms of the accused were found on the victim’s body and underwear and that a DNA test proved they were of the accused.

The court will reconvene on April 22.
