Court reduces sentence of forgery convict

A Pakistani salesman who was sentenced to three years in jail for forging a property ownership certificate and robbing a tenant has his sentenced reduced to six months by the Dubai Appeal Court.

The court upheld the deportation ordered issued against ASZ, 38, by the Court of First Instance.

According to the records, the tenant HS, 63, Jordanian teacher, testified that he was looking for a flat for his son.

“We searched the internet and there was an advertisement about two flats available for rent in a tower. We called the number of the person called ‘Nair’ and met him at the tower’s reception who then accompanied us to the 13th floor. We agreed on renting one of the flats for which he asked for paying the whole rent of Dh39,000 and Dh2,000 as commission to Sultan Properties, and Dh1,000 electricity and water deposit. When enquiring about his name, “Nair’ with the copy of the ownership certificate where the name was ASZ, he claimed that was his nick name and showed us his passport and residency visa to prove his real name that was the same as in the ownership certificate.”

The man’s son moved to the flat after issuing the cheque and paying the money for which he got receipts.

“A month later someone called ‘Iqbal’ claimed that he is a representative of the owner and handed an electricity bill of Dh400–500 value to be paid. 45 days later, someone called Mohammed Yousef called and claimed he is the real owner of the flat and that the documents I have are forged. He lodged a complaint with the Rents Committee which decided that the flat should be evacuated. He also filed a complaint with the police.

“I was told by the real owner of the flat that the accused had swindling cases amounted to Dh2 million,” he testified.

Criminal evidences reported that the photocopy of the ownership certificate was forged by changing the name of the owner.

ASZ had leased the flat from its real owner and then sub-let it by forging the ownership certificate which he had. He failed to pay the real owner the rent of the flat and sub-let the flat.
