Insurance firm forced to pay blood money

The Dubai Cassation Court  ordered a car insurance company to pay Dh200,000 blood money following an appeal submitted by the Dubai Attorney General.

The inheritors of a car accident victim sued a driver who mistakenly caused the death of their provider and asked for Dh2.2m compensation and blood money as the insurance company refused to pay the blood money.

The Civil Court, First Instance ordered the payment of the compensation and turned down their request related to the blood money saying in the ruling that the inheritors should follow up the execution of the penal court sentence which had ordered the payment of the blood money to the inheritors.

The inheritors appealed the sentence and the Appeal Court upheld the verdict of the First Instance Court.

As the inheritors did not appeal the case with the Cassation Court within the grace period, the Dubai Prosecution and for the favour of the law and its correct implementation, appealed the verdict.

The Prosecution noted that the ruling of the case included wrong implementation of the law since it mentioned in its sentence that the insurance company should pay the blood money against the traffic law and the terms of the ministerial decision regarding the unified insurance policy.

The Cassation Court accepted the appeal submitted by the Prosecution and awarded a verdict to the favour of the inheritors with the blood money.
