An Arab man has been sentenced to three months in prison and ordered deported from the UAE on charges of kissing a boy on his cheek but the ruling was rejected by the country’s top court which ordered a retrial of the defendant.

The court had earlier sentenced the man after finding him guilty of molesting the boy, aged under 14 years, while they were both in a car near a mosque waiting to pray.

The unnamed man then appealed the verdict but the court of appeals upheld that sentence, prompting him to resort to the Federal Supreme Court (FSC).

“The FSC ordered a retrial of the defendant after it decided that there was no evidence the man molested the child,” Emarat Al youm Arabic language daily said.

“The court said the man was right to appeal as he is convinced of not committing any offence…the court said it believes the kiss implied compassion and kindness.”
