The Dubai Court of Appeal has upheld the First Instance Court’s verdict of acquittal of a 23-year-old Emirati student who was charged with threatening to kill the family of a girl if he was not allowed to marry her.

MBM had become friendly with the girl after meeting her on Yahoo Messenger by pretending to be a girl.

According to the records, the 19-year-old victim MAH, Emirati student, testified that in 2011 she came to know a ‘girl’ via Yahoo Messenger and she continued chatting with ‘her’ for about three months before giving her mobile number and realising that ‘she’ was a boy.

“Because of his annoying phone calls which I did not want to answer, I changed the SIM card of my mobile phone.  So I was shocked when he called me on my new phone number. He called me several times saying he wanted to meet me. When I refused, he threatened to kill me and my family if I refused to marry him.

“One day he came to our house seemingly drunk, rang the bell and shouted at us to open the door. My mother came and I told her the whole story. When he called me later, my mother answered and asked him not to call this number. He then threatened to kill my mother and burn her car. My mother told him that if he calls again she will report to the police.  As he continued to call, my mother lodged a complaint with Rashidiya police station,” testified MAH.

SF, her 32-year-old mother and Emirati businesswoman, testified that on July 12 her daughter told her about how she came to know the accused and how he was harassing and threatening her.

“I called him from my phone and asked him not to call my daughter, otherwise I would complain to the police. He then threatened to kill me and my children if I did not allow him to marry my daughter. When he continued call my daughter and attacked the door of our house, I lodged a police complaint,” testified SF.

The Prosecution noted that the accused had a criminal record.

At first, the accused confessed to calling the girl and her family and that his marriage proposal was rejected.

However, he denied the accused when he appeared before the Court.
