Organ transplants from clinically dead permissible

Organ transplants from clinically dead Muslim patients is permissible, according to a latest fatwa issued by the Centre of General Authority for Islamic Affairs and Endowments in Abu Dhabi.

However, consent of the patient is mandatory. In cases where an approval is not taken before death, the deceased's heir needs to give their consent for organ donation. And if the deceased is unidentified, then approval from competant authorities is required. According to the fatwa, transplants from a clinically dead person will be tolerated if it helps save another life, reported 'Al Khaleej' newspaper.

Similarly, a clinically dead person can be taken off the life-support system only after doctors confirm the irreversible cessation of functions of heart and brain. Also, the advice of non-Muslim doctors can be considered when Muslim doctors aren't available for consultation. The centre was replying to a query of a person who wanted to know if Muslim patients who suffer from incurable illness can follow the recommendations of a non-Muslim doctors, especially when they declare patients clinically dead and allow organ donation. 
 
Similarly, if doctors find emergency medical procedures will not help revive a patient whose heart has ceased to function, then the same should be mentioned in the patient's medical records.
