Deportation for possessing 'indecent' items

Expatriates convicted of crimes, including possession and distribution of "indecent items" will be deported, according to Dubai Court of Cassation.

The court pronounced the ruling in the case of an Asian accused of distributing vibrators.

Dubai Public Prosecution charged the defendant of distributing obscene items (39 vibrators) and requested the court to punish him according to Articles (82, 121 and 362) of the Federal Penal Code No3 of 1987.

Initially, the Court of First Instance had sentenced him to one month in jail and confiscation of the banned items.

The Public Prosecution did not accept this verdict and moved the Court of Appeal requesting his deportation. The court accepted the Prosecution's request and ordered the accused to be deported after serving the jail term.

However, the accused, unhappy with deportation order, appealed before the Court of Cassation after 30 days. The court refused his appeal first on the grounds that the appeal was filed after a month of the lower court's verdict, according to Article 245 of the Criminal Procedure Code.

The Court of Cassation ruled that the accused be deported after confiscation of indecent tools in his possession rather than he serve a jail term.
