Man escapes rape charge, but jailed for sex

An Omani was awarded one month in jail for having sex with a Lebanese woman, but was ruled not have raped the woman, of which he was also accused.

ZH, 39, Lebanese, told the court, presided over by Judge Hamad Abdullatif Abdul Jawad, that the accused kept calling on her mobile phone.

On that fateful day, he called and asked about her plans for the day.

When she replied that she was going to have meet her friends for a drink, he invited her to have sheesha in a coffee shop.

He arrived at the hotel where she was staying and asked her to drive with him in his car. She sat in the front seat, where he picked up an argument with her.

He hit her on the head and she lost consciousness. Later, when she woke up she found him raping her in the desert in Umm Al Quwain.

Mahmoud Ahmad, from the Umm Al Quwain Police who investigated the case, told the court that an Emirati gave the victim a lift back to the hotel.

The victim was referred to Bur Dubai Police Station, he said and added that he does not know if she was subjected to a forensic check by UAQ Police.

The Omani was arrested following camera images from the hotel.

The court, however, acquitted ARA, 26, of kidnapping and rape charges after he testified that he had picked her up from the hotel where she was staying in Dubai to be dropped at Palm Beach Hotel in Umm Al Quwain upon her request.

She allegedly told him she had to attend a party there. He also confessed that he did touch her legs while she was sitting beside him in the car but denied raping her.

The Court of First Instance found him guilty only of having sex with the woman and sentenced him to one month in jail.
