Sharjah Court of Appeals has upheld the verdict of the Court of First Instance acquitting a housewife and her friend from charges of adultery and illicit relationship, reported ‘Emarat Al Youm’.

Majid Al Jallaf, the woman’s lawyer, told the Arabic daily that in May 2013 the woman’s husband had filed a lawsuit against his wife and the second accused -  a family friend - accusing them of adultery. He based his allegations on text messages and photographs he saw on his wife’s mobile phone.

He had also alleged that he had noticed a change in his wife’s behaviour, which led him to closely watch her. He alleged that the two suspects had even travelled to Bahrain together.

Meanwhile, in his testimony, the husband told the court that when he had confronted his wife and the other man with the SMS and photos, the duo admitted to being in a relationship. He told the court that he expected them to put an end to their relationship after that, but that was not to be.
Jallaf said the husband did not take into account the fact that to prove such evidences of adultery one should have the permission of the Public Prosecution and monitoring others’ mobile phone transactions calls is illegal.

Meanwhile, the wife had denied the accusations in court saying she is a mother of four kids. And Jallaf, her lawyer, claimed during court hearings that the husband levied such charges against his wife due to financial differences.

The lawyer also proved that the SMS used as evidence against his client was without the authorisation of the Public Prosecution or investigating authorities.

Similarly, the man’s father denied the charges levied against his son by the woman’s husband.

The wife’s lawyer, meanwhile, added that his client has the right to claim for compensation after her acquittal.
