Supreme court backs relatives in diya case

The Federal Supreme Court rejected a sentence by another court depriving relatives of a man killed in a traffic accident from diya (blood money) and returned the case to another court, a newspaper said on Sunday.

An appeals court had earlier turned down a verdict by another court ordering payment of Dh200,000 diya for the family of a man killed by a company van at a work site in Abu Dhabi on the grounds the accident took place off the road.

The appeals court backed argument by the insurance company that the driver’s car insurance covers only accidents that take place on the road and decided to annul an earlier court verdict ordering the company to pay diya.

“The victim’s relatives appealed the sentence with the Federal Supreme Court, which turned down the appeals court sentence and returned the case to another court for hearing,” ‘Emarat Al Youm’ daily said.

“The Court said it based its decision on the fact that car insurance is compulsory in the UAE and insurance companies have no right to include any terms in insurance policies covering such accidents.”
