Court deportation order can be delayed: lawyer

Expatriates convicted by UAE courts and ordered deported can have the sentence delayed or annulled by making a plea at the office of the emirate’s ruler in certain cases, according to a well-known UAE lawyer.

Abdullah Al Naser was replying to a question posted by an expatriate on ‘Emarat Al Youm’ newspaper on whether a deportation order issued by a UAE court against his 23-year-old brother can be delayed until the defendant who was convicted in connection with drug abuse completes his university study in the UAE.

The lawyer said all sentences issued by UAE courts are final on the grounds the judicial system in the country is autonomous.

He added that defendants who are ordered deported by appeals and cassation courts can still seek mercy from the emirate’s ruler in some cases.

They include that the defendant’s home country is in war and his life is endangered if he travels home or that all his family members reside in the UAE and he has no relatives in his home country, according to the lawyer.

If the convict is relatively young or is a student, he can seek pardon from the ruler since UAE punitive laws are “civilised and intended to rehabilitate rather than ruin the life of defendants,” Al Naser added.

“In such cases, the defendant can approach the ruler’s office or the public prosecutor by applying for pardon or a delay of the deportation order.

“The defendant should support the application with documents proving he is serious.

“Approval of the application remains in the hands of those concerned authorities,” he said.
