Cancelled work permit invalid if no worker's sign

Cancellation of a worker’s work permit by the employer without his signature on the application form is invalid, according to the Ministry of Labour, as reported by ‘Al Khaleej’ Arabic newspaper.

Mohammed Mubarak, director of labour relations office at the ministry in Dubai, said the ministry prevents cancellation of work permits by employers unless the employee has signed the cancellation form.

Mubarak's remarks came in response to a complaint by a butchery worker who had been sacked by his employer following a dispute between the two.

The complainant said he was surprised when the owner of the butchery gave him his passport and cancelled his residence visa.

When he went to the MoL to complain against the employer, he learnt that a six-month ban had been imposed because the employer had cancelled the visa before completion of the labour contract.

Mubarak stressed that the Labor Act has a complete chapter on disciplinary action and penalties which the employer can impose on the worker and procedures to be followed by the employer for punishing a labourer. The employee must be allowed to respond to the charges against him. The employer cannot take any decision against the worker without following these procedures, he added.

Mubarak said documents required include two types of labour permit cancellation forms which must be signed by the worker. The first type of form is for workers who have broken their fixed-term contract and the second is for workers with unlimited duration contracts who did not comply with the requirement for one-month notice period.
