Temporary work for other sponsor is illegal: top court

Employers hiring foreign workers on a trial basis are committing a labour offence which is punishable under existing laws, according to the UAE’s top court.

The Federal Supreme Court (FSC) issued the ruling while overturning previous sentences by two courts acquitting a UAE employer for hiring an expatriate worker on a trial basis.

The FSC upheld a sentence jailing the worker for one month for stealing his employer’s mobile pho ne but overturned the acquittal of the employer after an appeal by the prosecution.

“Hiring a worker on a trial basis without abiding by sponsorship rules is an offence punishable under existing labour laws,” FSC said.
