Hamdan issues resolution

Sheikh Hamdan bin Mohammed bin Rashid Al Maktoum, Crown Prince of Dubai and Chairman of Dubai Executive Council has issued the Executive Council’s Resolution No (9) of 2015 organising the work of social service providers in the emirate of Dubai.

Applied on social services providers in Dubai, including special development zones, free zones and Dubai International Financial Center (DIFC), the resolution aims to enable Dubai’s Community Development Authority to oversee and govern the establishments that provide social services with exception for the licensed social services providers inside the International Humanitarian City and Dubai Healthcare City in addition to Dubai Foundation For Women and Children.

The resolution defined the social services as the services that generally contribute in social development, and the services that protect, attend, enable and reintegrate the most vulnerable segments of the community. These include providing educational services, consulting services, non-medical housing services, day and home care services, social rehabilitation and protection from abuse and negligence.

The resolution also defined social services beneficiary to include senior citizens, people with special needs, victims of domestic violence, juveniles, delinquents, underprivileged and foundlings.

The responsibilities and authorities of Dubai’s Community Development Authority, CDA, as prescribed by the resolution, include defining the social services permitted for establishments, setting the terms, conditions and technical specifications for social services providers in line with the international practices and applied legislations, receiving and approving registration requests, overseeing social services providers, receiving and investigating complaints and taking any required measures against violating establishments, establishing and managing a database for social services providers in the emirate of Dubai and organising training activities.

The resolution also prescribed the obligations of social services providers, that includes providing the permitted services only, providing insurance for their workers, keeping records for all their services recipients for a period not less than ten years, submitting financial records for donations and grants to Dubai’s CDA, protecting the privacy of their services recipients and giving a 30 days prior notice to the CDA in case of cessation from providing services.

The resolution also compels the service provider to maintain public health and safety measure in their facilities, refraining from any act that could risk public security or violate the Law, adoption of scientific methods and use latest technologies when providing social services and informing CDA about any partnerships, agreements or contracts with local, regional or international organizations.

The resolution also prescribed requirements for the establishment’s owner that should be over twenty one years of age, enjoy full legal capacity, enjoy sound reputation and capable of fulfilling the establishment’s obligations.

The resolution includes a supplementary appendix that defines the violations and relevant penalties and fines. All social services providers must abide to this resolution and its articles within six months from the date of its validity. This Law is valid from date of publication in the Official Gazette.

This resolution annuls any other law or legislation that contradict with any of its article.
