Hamdan issues resolution on fines

Sheikh Hamdan bin Mohammed bin Rashid Al Maktoum,  Crown Prince of Dubai and Chairman of Dubai Executive Council, has issued Resolution No (47) of 2014 regulating the installments of the fines due to the Government of Dubai.

The resolution states that the director general, executive director and secretary general may approve the installment of any fine; conditionally the applicant explains the reasons for his request. The request is to be approved duly and according to the policies and procedures prescribed in the resolution.
 
According to Article (3) of the resolution, the fine should not be less than Dh5,000 for individuals and Dh20,000 for entities and the installment’s period should not exceed one year starting from the date defined the concerned government’s entity. The director general, or whomever he delegates, may increase the installment’s period for another year if the fine exceeds Dh30,000 for individuals and Dh250,000 for entities.
 
Pursuant to the resolution, applicant must defray 25 per cent of the total fine’s amount upon approval on the installment’s request, and the installment’s defray must be in cash or via any instrument defined by the concerned government entity. Each installment must be less than three months in separation. The director general may adjust any due installments or separation periods and may delay due payments conditionally all installments are defrayed within the period defined by the director general.
 
The resolution, considered valid from the date of publication in the Official Gazette, also prescribed the measures against the person defaulting in payment without a reason accepted by the director general after obtain approval on his installment’s request.

The new resolution annuls the Executive Council’s Resolution No (40) of 2011 on installments of traffic valuations in Dubai and any other resolution contradicts its articles. The new resolution aims to encourage the individuals and entities to pay their fines due to Dubai Government and unify the installments procedures in the emirate.
