No 'No-objection' needed from ex-employer

Ministry says rule cancelled with enforcement of new labour laws; Residents on family visa can seek employment

The UAE has cancelled a labour rule requiring private sector workers to get a “no-objection” letter from their employers when shifting to a new sponsor, the semi official daily Alittihad reported on Tuesday.

A labour ministry committee holding its weekly open-day meeting on Monday said such a condition had been dropped since the country began enforcing new labour and sponsorship laws early this year, the paper said.

“After considering many applications during its open-day meeting, the committee made clear that the so-called no-objection condition granted by an employer to a worker seeking to shift sponsorship no longer exists,” it said.

“The committee stressed that no employer has the right to give such a letter to any worker now that the new job and sponsorship rules are enforced.”

Family visa, can work

Residents who are on their family visa have a right to seek employment under contracts of both, limited and indefinite durations, just like any other person in the UAE.

This was stated during a weekly meeting of the Ministry of Labour and representatives of various institutions on Monday, according to an Al Khaleej report.

A no-objection certificate for such work permits has to be cleared and granted by the ministry, but officials clarified that there is some confusion at typing centres, that those on family visas can only work on fixed-term contracts.

An official said: “This is not true.”

Officials added that the ministry is the only body authorised to apply a six-month ban in the absence of en employee violating a two-year contract.

This came in response to a complaint submitted by a worker, where he said the company canceled his labor card and claimed to impose a ban after he was terminated by the facility.

    Fixed contract system only need apply for labour class. Some companies have now started issuing limited contract to all of their employees. Labour ministry should monitor it and need to control crooked employers

    Hey Rahul. I have faced the same problem you are facing. Things won't go good if your employee isn't working with you right. But trust me there are some good people out there. Inshallah you will find them.

    Obviously, financially growth is one reason why people might work with you. Let's keep it this way. You guys don't know what I have faced with my employees and problems they caused during festive holidays. You give them increment, support, leave, emergency leave when needed and by the end of the day they bite back.

    Seems Mr. Rahul was lucky enough to find greedy employees only. Dedicated and trust worhty employees are far from his reach because, there is some "hidden" reason. Find out what is wrong?

    What Rahul has trouble understanding is that employers DON'T OWN employees. They are simply paying for the 8-9 hours of service being provided by the employee. The whole purpose to life is growth. If the employer does not offer that, the employee will obviously leave. C'est la vie so please be mature.

    I party agree with Rahuls point, however today's management should look at motivating and empowering employees. Money is not the only motivator but a good & fun working environment with equal rights are what everyone looks for in a long career with a company.

    Mr. Rahul. We will stay longer in your company if you are treating us very well. Staying in the company for the rest of our career is GOOD for our retirement and end of service benefits. If employee's asking for more their is something wrong with your management. Why some company employing people for more than 15-20 years? Rahul?

    Dear Rahul, you also must have done the same thing when getting a job in the beginning. Also, a person doesn't change a job simply; there will be a strong reason always.

    This rule should be applicable to those with a solid reason. Some employees beg for a job in the beginning. Once they get it, they act like they are the employer and follow their own rules and wishes.

    Hopefully the MoL will scrap the limited contract system. All workers should have unlimited and freedom to change a job.
