An angry Saudi judge set precedence when he ordered the release of a defendant accused of having an affair with a girl to protest a decision by the prosecutor to charge only the man, a newspaper reported on Tuesday.

'Okaz' quoted judge Sheikh Mazin Sanadi as saying the prosecutor’s decision was unfair and amounted to discrimination and bias for the girl, who works as a nurse.

“The measure taken by the prosecutor violates justice.

“The girl must also be charged and referred to court,” said the judge in the Western Red Sea port of Jeddah.

“I understand that the prosecutor did not want to cause a scandal and expose the girl, but justice is justice. Either the two are tried or no one.”

Okaz said the judge ordered the release of the defendant on bail and stipulated that he would only stand trial when the girl is also brought to court as a defendant.

It said the man was caught inside the girl’s bedroom at her home in Jeddah after she let him in for the night before she went to work in the morning.

“She saw her brother sitting in the main hall in the morning. So she asked her lover to stay in the bedroom until she comes back from work, but he was discovered and arrested by the police,” the paper said.
