Expatriates involved in obscene acts, including flipping the finger, can be deported, the Dubai Court of Cassation has ruled.

The court was hearing a case of a Pakistani who was challenging his deportation.

The court, headed by Judge Mohammed Nabil Riyadh, rejected his appeal, based on the text of Article 121 of the Federal Penal Code No3 of 1987, which stipulates "the deportation of the foreigner who committed indecent crimes, including indecent and illegal acts".

Dubai Prosecution referred the defendant to the court of first instance on charges of gesturing indecently at AR and MAA.

The court sentenced him one month imprisonment followed by deportation.

He, in turn, appealed before the Court of Appeal, which upheld the ruling.

The defendant didn’t accept that ruling either and moved the Court of Cassation.

The court ignored his explanation that he disturbed by plaintiffs, who allegedly honked their car continuously.

His argument that gesturing is not an indecent act was rejected by the court.
