Wife uses hubby's name for illegitimate child

A married Indian woman and her Indian businessman lover have been sentenced to six months in jail, followed by deportation, by the Dubai Court of First Instance.

The couple had a child, born out of wedlock.

The woman, however, used her husband’s name on the birth certificate of the illegitimate child.

The court verdict is based on a defamation case filed by the woman’s husband, an Indian welder from Thiruvalla, Kerala, who was working in Brunei when the woman conceived and delivered the baby.

The lady has also been sentenced for an additional year in jail for misleading the Dubai Healthcare Authority (DHA) about the father of the baby.

 Married since February 1999, the couple have a 14-year-old son. 

The husband, who was working as welder in Dubai, brought his wife here and she got a job with a private hospital group. But couple had some discord since 2008 and divorce proceedings has been going on. However, they are still legally married.

Her husband asked her to stop her illicit relationship and return to India, but she continued to work in Dubai and got pregnant with her lover.

“The case relates to the birth of an illegitimate baby by the woman in 2011, when her husband was working outside the UAE in Kuwait and Brunei.

“After realising that his wife conceived and delivered a baby in his absence in a private hospital and that the birth certificate and insurance claim for the maternity expenses used his name as the legitimate father of the baby, he approached the Dubai Public Prosecution through our legal firm,” said Advocate Shamsudeen Karunagappally, Al Kabhan Advocates and Legal Consultants, who represented the complainant.

Shamsudeen said the judgment is very unique and the husband is now planning to sue the lover of his wife for Dh2 million.

The baby is two years old now and may also have to go to jail with the mother.
