Witness not located in Mark Arnold case

The Dubai Prosecution could not locate the new address and did not summon the second witness in the case of Mark Arnold, British, who was convicted for 15 years in jail by the First Instance Court for killing his South African ex-girlfriend Kerry Winter, 36.

The jury of the Dubai Courts of Appeal read out the response of the Dubai Prosecution and the Aronld’s defence lawyer asked the court to submit his argument.

In the previous hearing, the court received a reply form the Ministry of Interior stating that Morris Wibro, the company’s Logistic Director who is the second affirmative witness in the case has a new address other than the one in the case’s file which has been cancelled on February 19, 2009.

The court adjourned the case until October 31 for the Dubai Prosecution to summon Wibro to make his testimony before the court.

With not locating Wibro the case is left without any affirmative witness since the first response of the Ministry of Interior has stated clearly that the first affirmative witness Asghar Khan, the company’s driver has left the country since November 11, 2008.

The defence lawyer Yousuf Hammad had asked the court to hear the testimony of the affirmative witnesses who according to the prosecution accusation sheet had been asked by Arnold to buy him tools he needed to commit his crime, but was without their knowledge why he needed them.

“The court did never hear the testimonies of any of the two affirmative witnesses and their sayings had been given great value and weight by the First Instance Court and its verdict,” he told Emirates 24|7.

The court adjourned the case until November 24, for the defence argument upon the request of the Arnold’s defence lawyer who has given up on listening to affirmative witnesses.
