Notary public to endorse will of non-Muslims

The notary public at Dubai Courts will start from the beginning of October to ratify the signature of non-Muslim testators in line with the requirements and needs of clients.

Abdullah Abdul Wahid Al Ali, acting director of the notary public, said the Dubai Courts will begin the ratification of the signature of non-Muslim legators based on the public notary law and on the basis of a memorandum prepared specifically for this purpose.

He added that Judge Jassim Baqer, chairman of the Court of First Instance, issued a decision on the ratification of the signature of non-Muslim testators only by a notary public. He noted that the move aims to raise customer satisfaction for services provided by the notary public.

Baqer explained that this certification does not necessarily mean implementation of the recommended things, but it is subject to the laws in force and according to court chairman's decision.

He added that ratification of the signatures of non-Muslim legators were in the past endorsed at the consulates and embassies of the people concerned and some private offices licensed at the free zones, indicating that with this step, the notary public Dubai will be the only government agency that will provide this service.

Baqer stressed that a client who seeks to ratify his will must prove he is the owner of the recommended funds. He must be present or authorise an agent on his behalf. The will could include movable assets and real estate inside and outside the state.
