You work less you lose your job. You work overtime and expect to be rewarded all the time - think again.

Sharon Smiley had been working in a real estate company for 10 years. But she lost her job because she decided to skip her lunch and instead finish her pending work.

It’s been two years now 48-year-old Smiley is entangled in a legal battle with her former employee.

Smiley who was a receptionist and administrative assistant recalled the incident and said that she was asked to go to lunch and step away from her desk, but she refused.

Her manager observed Smiley working on the project during her lunch hour.

The human resources director said it was violation of company rules and Illinois' labour laws.

The fact that Smiley worked during her lunch hour cast a bad light on the company's image.

Since she was discharged for misconduct, Smiley was also ineligible for unemployment benefits, reported ABC News.

Smiley was also under lot of stress while working and suffered health issues.

After approaching the Illinois Department of Employment Security's board for 3 times, Smiley finally took her case to a circuit court. But she did not challenge the firing.

The court ruled the case in favour of Smiley for unemployment benefits.

She now has a new satisfying job.

    I agree with her discharge, unless the company expressingly request that you work through your break hour, you are not entitled to payment of wages for time worked. Secondly, if policy clearly states that all employees must take a lunch break then policy must be followed by all including management and management enforcing policy. The manager and HR person would have been in violation themselves had they not taken action. She was in the wrong.

    The law is the law. The company I work for was sued and had to pay $25 million in back wages to people who, by their own choice, worked during off-clock hours. Now, they make it very clear that working when you are off the clock will not be tolerated. Labor laws state you must take a lunch break, and the company will fire you if you don't. I see nothing wrong with that.

    She was told to do something by her employer and failed to do so, so they have every right to let her go.

    The manager did not want her there, plain and simple .. he had someone else he wanted to have in that position.

    That company should fire the manager and the HR personnel! And not that very hard working employee... this is the craziest thing that I've ever heard!

    Her boss and the HR guy should be seriously ashamed of themselves... they don't even deserve their own jobs. Fire a woman from work is more favourable than a 'possible' fine! How do you want loyalty when you don't care about your staff? That's a message for everyone, not only them.

    It is company managemet teams like that 'force' people to pretend they care while they're actually waiting for their salary at the end of the month.

    Most companues are squeezing their employees with 10 minutes break and overtime to finish pending jobs - it is not good for health, so the government needs to issue compulsory break rules for all employees - at least half an hour.
