Sharjah law limits property ownership

Sharjah has issued a law on real estate registration that has limited the right to own real estate in the emirate to UAE nationals and nationals of GCC states and corporate bodies fully owned by them.

His Highness Sheikh Dr. Sultan bin Mohammed Al Qasimi, Supreme Council Member and Ruler of Sharjah, has issued Law No. 5 for 2010, on real estate registration in Sharjah.

“But exception may be granted by the Ruler to own property through the inheritance transition in accordance with sharia declaration, legitimate or waiver of the owner to a relative of the first degree as prescribed by executive regulations of this law,” the law clarified.

According to the law, the Department of Real Estate Registration and branch offices in Sharjah are only institutions tasked with registration of contracts, papers and documents relating to the real estate in the emirate. They will maintain real estate records and recording of dispositions, preparing printed contracts that require the provisions of this law and other related matters.

“The transfer of property ownership will not be legal unless bill of ownership is valid and registered in accordance with the provisions of the law,” the law said.
All real estate transactions, which were effected legally before this law comes into force, are legally valid.

The law has provided for setting up of a committee or more committees to be named “Ownership Verification Committee” by the department. The members of the committee will be composed of efficient UAE nationals with integrity, said press statement.

The committee/ committees will directly report to the department.
The law will be effective from the date of publishing in the Official Gazette.
