Four years jail sentence to passive drug users

Passive smokers accompanying someone smoking hashish or marijuana will be sentenced to four years in prison in the UAE.

Jail will be rewarded in case the blood test of a passive smoker show traces of drugs in his blood.

If the proportion of drugs detected in the urine of a person is more than 50 Nano grams it means the person is positive to drugs and will be submitted to court for abuse of narcotic substances.

Passive smoker who is accidentally exposed to drugs will be sentenced to 4 years, just like the actual abusers.

While drug abusers will be punished for four years as well possession and consumption will be subjected to the same punishment.

Drug traffickers will be subjected to stringent punishment which may account to life imprisonment (25 years).

It is worth mentioning many residents and visitors don't recognize the fact that the UAE anti-drug federal law imposed very strict and tough punishments against the drug abusers, promoters and traffickers.

For instance, a French businesswoman, 22, was sentenced to 4 years because of abuse of cannabis and possessing 5 cigarettes containing hashish (drug) in her cigarette box.

Another case reflect the ignorance of visitors and residents of the anti-drug federal law; an Italian national who is originally from an Arab country was arrested in his hotel room smoking hashish.

D Nasser al-Ansari, the first expert's at the poison center of the Dubai criminal evidence department of Dubai Police confirmed, "The keenness and the interest of the legislator is not to jail innocent individuals such as passive smoker. It is taken into account the standard (Nano-grams) engagement in abusing drugs.

In case of a passive smoker few conditions are taken into considerations - the size of the room and the number of drug users.

However, the most important evidence is the report of the medical examination, which may be positive or negative according to the proportion of drug in the body of the person accused.

The judge Al-Shinawi stressed, "Many defendants assert that they are not drug users and asserted they are negative abusers for cannabis, but if the result comes positive, which means they were not passive smokers, but are practical smokers of drugs."

Judge Al-Shinawi is advising members of the communities not to keep bad company in order to avoid accusations of drug abuse and land in prison.

On the other hand, Major Hassan Ayoub of the Department of Dubai anti-narcotic confirmed, "The campaigns of Dubai police never differentiate between negative and positive drug users, the police arrest all persons in the place of abusing."

He pointed out, "The medical reports will indicted if the person is truly negative for drug abusers or positive by up to 95%".
