Brother kills sister’s husband for marrying against family’s wish

A Pakistani, at large, allegedly with the agreement and incitation of his brother, killed their sister’s husband, a taxi driver, in revenge for marrying the woman against the family’s will, the Dubai Criminal Court heard.

On November 19, 2014, when the victim failed to return a car to Dubai Taxi, the employer called the driver but the latter did not answer the calls. 

The company found the car’s location when they traced it via the device fixed in the car.
 
The body of MT was found in the car, so the company informed the police.

Lieutenant Bakhit Saeed was assigned to check the crime scene and investigate the case.

The victim’s brother told the police that he suspected the two brothers of the deceased’s wife as they opposed their marriage. He also told police that the two brothers caused many problems for the deceased in his country.

“A day before the crime, my brother received a phone call from his wife’s elder brother, FA, 34, and the latter asked him to meet in Satwa to settle their problems. He told me that before going out to meet FA.

“As he was late, I called him several times on his mobile but he did not answer. I received a phone call from my cousin in Pakistan telling me that FA is in Pakistan and is saying that he killed MT. I searched for my brother who did not answer my phone calls. Then I reported him missing to the police who told me that they had found his body in a car,” the deceased’s brother testified.

Police found out that FA fled the UAE via Dubai Airport six hours before the crime was discovered.

Police searched for FA’s brother AA, 26, and found out that he lives in the same area where the crime was committed.

AA told the police that he came to know that his brother killed their sister’s husband from his family back home. “I received a call from my family who wanted to be sure that FA killed our sister’s husband because he told them that when he reached Pakistan,” AA told the officer.

AA was sure that his brother killed MT when police arrested him after finding the victim’s body, he claimed.

Telling why his brother did that, AA said that MT had married their sister without taking the family’s consent. “He incited my sister to elope with him and get married as my family had rejected him as a husband. We were planning to kill him in Pakistan and not in the UAE. When we entered the UAE, my brother told me that he wanted to kill him here.  But I asked him to wait until he returned to to Pakistani. My brother killed him without my knowledge,” AA told investigators denying any participation or knowledge about the murder.

Lieutenant Mohammed Abdull Aziz testified that the crime was committing in an area different from where the car was found.

“There was sand on the back seat and on the victim’s clothes. Also, there were no traces in the area where the car was stopped. The victim’s body was found inserted between the front and the back seats. The crime must have been committed somewhere else and the body of the victim brought and put in the car. It is not possible to commit such a crime in a busy area,” he testified.

Forensic reported that the victim was strangled with a plastic rope that was found around the neck. It also reported traces of sand on the back left door and footprint on the back seat, in addition to sand on and in the victim’s clothes, proving that the body was moved into the car after the murder. The stiffness of the victim’s muscles also proved that the body was moved after death.

Bruises and scratches in addition to a bite were found at different areas of his body. The victim saw his attacker or attackers as most of the bruises were on the front side of his body.

Criminal Evidences reported fingerprints of the fugitive on the victim’s car.

It also reported that the DNA on the bite on the victim’s right arm, a lighter of the car and a glove found in the car were those of a male but differed from that of AA.

Fingerprints of someone other than that of the victim were reported on the car’s driving wheel.

DNA of a male other than the victim were found under the victim’s nails, but did not also match with AA’s.

AA, who is accused of inciting his brother to kill the victim, admitted to agreeing to kill him but in the UAE.

The court will reconvene on February 28.
