Dad can’t sue doctors over child’s death due to high court fees

An Arab man seeking to sue doctors over a presumed medical error that led to the death of his little daughter stopped the process after he was told to pay Dh30,000 in court fees, a newspaper reported on Tuesday.

Maher Turki, a government employee, said he believes his daughter Mawadda died because of a medical error after she was admitted to Lateefa hospital suffering from intestine illness, Emarat Al Youm said.

After investigating the case, the Dubai Health Authority ruled out medical errors but told Turki he still has legal rights in the case.

“I went to Dubai courts and filed a case against the treating doctors but I was shocked to learn that I have to pay Dh30,000 for the case. I could not pay this sum given my low salary,” he said.

“I requested an exemption after I read in a newspaper which quoted a judge that some cases could be exempted from fees or payment could be delayed until after the settlement of the case, but my request was rejected.”

The paper quoted a court official as saying Turki’s application was turned down by a court committee which deemed it is not included in cases that are entitled for a fee exemption or postponement.

“All I ask now is that they exempt me or a benevolent person pays these fees so I can sue the doctors who caused my daughter’s death,” Turki said.
