Driver on trial for sexual attack on employer’s nine-year old son

A 9-year-old boy who was sent by his mother to his father’s restaurant to bring soup was sodomised by the restaurant’s driver, the Dubai Criminal Court heard.

SAG, 36, threatened the little boy who attempted to run away from him with cutting his neck if he told anyone. The boy grabbed the chance to run away from the driver when the latter received a phone call while he was into the act. He ran for a short distance before his attacker put on his trouser and chased him in the car until he caught up the boy and pulled him back into the car.

The driver drove the boy back to his father’s restaurant and asked him to go home. The mother of the boy was sleeping when he returned home.

He went to her room and hugged her. “I was astonished by the intimate hug and I saw blood stains on his trouser at his lower back. Asking him about the stains, he told me it is food colour . When I argued with him that tit cannot be food colour powder, he told me that his toe was injured and that his hand must have brushed against his back after touching the wound.

“He showed me the wound on his toe. But I became suspicious when he touched his buttocks which I checked but did not find any sign of violence.  I was not convinced by my son’s story and so I spoke to his father.  My boy told his father how he was sodomised by the driver,” said the mother.

“I was scared of driver who threatened to cut my neck if I told anyone,” said the boy. “I was walking to my father’s restaurant to bring soup when the driver stopped by me and asked me to get into the car. I refused and told him that I am going to the restaurant, but when he insisted I entered the car.

“The driver drove to the vegetable market and bought some food and then he entered a spice shop and bought some food colouring powder which he gave to me. Some powder fell on my trouser. The driver met a friend in the vegetable market and the latter asked him for a lift to Dragon Mart

“I was sitting on the back seat when the driver took the car to a sandy area where he asked me to take off my trousers.  When I refused, he pulled me out of the car and pushed me into the sand and forced me sit in a certain position before pulling down my trouser. He also took off his trouser and started attacking me without paying any attention to my screams and shouts of pain.

“When he answered a phone call, I ran away. But he chased me with his car and pulled me back into the vehicle. He drove me to the restaurant and then asked me to go back home,” testified the little boy.

The father knew that his son was with the driver because when he called the driver he heard his son’s voice when the two were in the vegetable market. The father did not mind that his son was with the driver and went to sleep.  After more than two hours the boy returned home from the restaurant which is only 500 metres from their house in International City.

“My employer’s son came to me and asked for soup. I asked him to wait until the soup is ready.  The driver told me that he wanted to take the boy to the vegetable market. I told him not take him. After some time, I noticed that the driver and the boy were not in the restaurant,” testified salesman SWM, 24.

The salesman called the driver several times. He answered once and told him that he will be coming back in five minutes before switching off the mobile.

“When he returned, I asked the driver why he is late and why he took the boy with him, but he did not reply.  When I asked him about the boy, he told me that he had gone home. He refrained from answering my questions and asked me to go and rest. I went and asked the boy’s mother who is my cousin about him and she told me that he had gone  to sleep,” testified the salesman.

The accused behaved abnormally when he was confronted by his employer. He kept silent, his hands were shaking and he looked scared.

The next day, the employer gave the driver his papers and passport and asked him to leave the UAE and told him that he will make him pay for his deed in their home country of Afghanistan.

“When the driver heard that, he became angry and assaulted his employer with his hands.  The restaurant’s owner tried to defend himself and all the workers intervened to push them away from one another until police arrived and the two were taken into custody by the police,” testified the salesman.

Forensic reported that the boy was subjected to sodomy and that there were wounds in the area. However, the sample taken from the boy’s body was insufficient for the test. The boy’s father also had some scratches and bruises.

The Court will reconvene on July 15.
