The Dubai Criminal Court of First Instance acquitted for the lack of sufficient evidence a Nigerian who was allegedly found in a prostrate position in his room by a resident of a house.

The flat’s occupant saw a man in his room when he woke up at 3am to go to the toilet. He tried to catch him but the latter jumped out of the window and fled.

BA, 20, an unemployed Nigerian, was later arrested and admitted to theft from the house. He told investigators that he had climbed the fence of the building and a tree to reach the window which was not firmly closed and got into the victim’s flat.

When VK, 54, businessman woke up, he saw a man in a prostrate position in the room. “I jumped on him but he resisted strongly and pushed me to the floor and rushed towards the window and jumped. Checking the missing things, I found out that he had stolen Dh1,850, US$100 and Indian Rs2,500 besides two watches,” the victim testified.

The accused admitted to the police that he had bent down on the floor when he felt that the occupant of the room was waking up so that he does not see him. He admitted to stealing only Dh100 from the victim’s wallet.

However, he denied the accusation in court.
