An Emirati building inspector, who used a sheikh’s health card as an ID when he was asked to submit an identification document, was sentenced to three months in jail.

JKS, 27, Emirati, was also ordered to pay Dh2,000 for assaulting a public servant and police officers in front of his house.

Policeman Mohammed Mousa, 30, testified that on August 14, 2011, while he was on duty in l Satwa area, some people stopped him and told him about a brawl.

“I moved with them and reached the place were two people were fighting, one of them an Emirati and the other an Afghani. I asked them to submit their identification cards. The Emirati submitted the health card of a member of the ruling family of Fujairah. I notified the patrol in charge of the area and handed over the identification cards of the two.

“On the following day, I received a call from my colleague telling me that the Emirati did not belong to Fujairah’s ruling family and was arrested in Safa area. I went there and ensured that the arrested man was the same who was involved in the brawl the day before,” he testified.

Corporal Fawaz Jafar testified that on August 17, 2011, while he was questioning some Pakistanis in Safa area, a car passed by making a loud noise. “I followed the car until its driver got into a villa and closed the parking gate behind. I asked the driver for his ID and he presented a health card of a member of the Fujairah ruling family but the picture was not clear and he did not hand over the card to me. He claimed his car has eight cylinder which was the reason for the big noise. He blamed me for questioning a sheikh.

“On the next day, the accused was asked to hand over the card and a diplomatic passport he also used. After several requests, he finally handed over the card and the passport which he claimed belonged to his friend who was a member of the ruling family,” he testified.

Corporal Nasib Abbas testified that while was on duty at Jumeria 3 area behind Al Safa Cooperative Society he saw a car with a highly tinted glass. Checking its number, he found out that its registration had expired. He stopped the car and asked the driver for the driving licence. The driver said that he does not have it with him right now and submitted the diplomatic passport of a Fujairah sheikh.

“There was not sufficient light in the area so I could not see the picture on the passport, so I let him go. A week later a colleague called me and told me that he had stopped three people, one of whom was riding a BMW and who claimed that he is a sheikh. From the description, it was the same car that I had stopped recently.

“Moving to his house, the driver’s mother came out of the house. We asked her if she is from the ruling family of Fujairah. She negatively answered. Since our suspicious had been aroused, we waited in front of the house. The accused came out of his house and asked us to remove the police cars in front of the house.

“When asked to present his ID, he presented an ID with his real name. When told that he had earlier submitted a health card and diplomatic passport belonging to a sheikh, he initially denied it but later confessed. He claimed that the sheikh (the holder of the documents)had  told him that he could use his ID should he get into trouble,” he testified.

Other police officers, who were involved in solving problems created by the accused in public, repeated similar testimonies.
