An Egyptian cook allegedly premeditatedly killed a man and attempted to kill another one by stabbing them several times with the same knife in revenge for sodomy, the Dubai Criminal Court heard.
On September 16 at around 5.30am, residents of a building at Al Barsha 1 area woke up to shouts and screams for help.
“I opened my flat’s door and saw my Jordanian neighbour MM who got in before falling unconscious. He was severely bleeding from his neck. I immediately called the police,” testified SS, Indian neighbour.
Police arrived at the scene and on entering the victim’s flat, they found FM, Egyptian, on the floor in front of the bathroom bleeding from stabs in the chest and belly.
FM was rushed to hospital for treatment of his deep stab wounds.
He told the police that he arrived in the accommodation provided by the employer at around 10pm.
“The accused was sitting on the victim’s bed and was playing a game on his mobile. Another roommate ‘Sami’ was sitting on his bed. I asked the accused to have dinner with me but he refused. I had my dinner and then took a bath before going to bed. At that time, Sami was sleeping. I talked to my family back home. At around 4.15am, the victim came and greeted us before going to bed,” testified FM.
The accused switched off the light. At this time, Sami woke up and entered the bathroom.
“Suddenly, I heard the victim telling the accused: ‘Why is that?’. I got up to find out what was the problem.
“Shockingly, the accused turned to me and stabbed me several times in different areas of my body before dragging me. Then I ran to the bathroom before I got out and fell unconscious,” FM told police.
FM learnt that his roommate MM had died in hospital.
FM told police that Sami did not involved in the attack and that he was only present there.
Bloodstains were found in the corridor of the building’s third floor where the crime happened.
Police arrested AT, 26, who admitted to stabbing the two victims in revenge for sodomising him. He told police that he had got rid of the knife in a garbage bin.
However, he denied premediated murder and said it was in self-defence. He claimed that before sleeping and while in bed, he heard the two victims were making fun of him that they had sodomised me while I was sleeping without me knowing about it.
“I slept after that and then I woke up when I felt someone trying to sodomise me after pulling down my trousers and underwear. I pushed that person down from the two-storey bunk bed. I did not know who he was because the room was dark. I fought with him and found out that he was MM. While fighting with him, he pulled out a knife and threatened me with it. Then, FM intervened and tried to catch me while MM was beating me up and threatening me with the knife,” the accused said.
“I snatched the knife from his hand and defended myself he got wounded while we were fighting. Sami was in the bathroom preparing himself to go for work at that time and did not intervene in the fight. I rushed down the building and asked the security to call the police,” the accused told prosecutors.
When he heard the shouts, Sami got out of the bathroom wearing only his underwear.
“I saw blood everywhere including on the bed of the victim. FM was on the floor bleeding. I went to the other flat where other company staff were residing and asked them for help. At that time, the accused came out of the flat and abused me, punched and slapped me saying: ‘Are you with them, you son of dog?’ I did not know why he said that,” he said.
Sami, accompanied by other residents, put on his clothes and went down the building using the stairwell and stayed there until police arrived.
Forensic reported that the victim sustained four stabs, two of which were deep and fatal.
One of the fatal stabs was in the neck that reached from the left side to the throat and the other was in the belly and reached to the liver.
Tests proved that the victims did not consume alcohol, drugs or aphrodisiacs.
Before the court, AT denied the two accusation of premeditated and attempted murders. The court will reconvene on May 11.
