Waiters threaten restaurant owner

Two restaurant waiters allegedly threatened their employer with posting a recording of him agreeing to meet a woman in a hotel if he did not drop the absconding report that he had lodged against them with the Ministry of Labour, the Dubai Criminal Court heard.

MYA, 22, Moroccan and AIS, 35, Egyptian, are also accused of interfering in the private life of their employer KAH by sending the recording to his fiancé and employees.

KAH, 43-year-old businessman, testified that last February he received a call from AIS asking him to drop the absconding notification or he would damage his standing with his fiancé and the Egyptian community in which he was a prominent figure.

“I did not give attention to the threat. However, on the next day while I was in the restaurant, I received an SMS from the mobile number of AIS saying that he and MYA have a recording of me while I was drunk agreeing with a woman on a meeting in a hotel.

“A little later I received another message from them asking me to come near the Burj Khalifa metro station. I asked a policeman who was in the restaurant to join me. We went and met the two who repeated their threat to me… At this time a third person MM was with my fiancé. He gave an audio material to my fiancé because of which I had a row with her.  So I lodged a complaint with the police against them,” he testified.

First Corporal Khalid Mohammed testified that he accompanied the victim to the location specified by the two workers and heard them threatening KAH to force him to drop the absconding complaint he had filed against them with the Ministry of Labour.

The victim’s fiancé and partner, HM, 31, Moroccan testified that MM came to her while she was in the restaurant and made her hear a recording of KAH talking to a woman and asking her to come to him in a hotel.

“I got angry and went out of the restaurant and saw KAH standing with the two accused. I called him and confronted him with the recording and had a fight with him,” she testified.

AML, 29-year-old regional manager of a TV station, and a guest at the restaurant, testified he saw the couple fighting outside the restaurant.

“Asking KAH about the reason, he told me that two absconding workers had made up an audio recording of him with a woman and made his fiancé listen to it,” he testified.

A waiter in the restaurant, YAM, 34, Egyptian, testified that a few days before the incident, he heard AIS talking to MM and telling him that he will spring a big surprise.

“On the day of the incident, I saw AIS and MYA outside the restaurant with MM. A few minutes later MM entered the restaurant and made the employer’s fiancé hear a recording of the employer asking a woman to come to him in a hotel. The employer and his fiancé had a fight because of the recording. When I returned to my accommodation, MM sent me the recording on my mobile and sought my opinion about what he did today in the restaurant,” he testified.

The prosecution supplied the court with a recording of the threat on a CD.

The court adjourned the case for verdict until April 21.
