A Swedish girl has lost her appeal against the acquittal of a 27-year-old man she charged with raping her because the court ruled that the man could not have known she was under age because of her “well-developed” body.
According to a report published by website thelocal.se the girl said she was raped while on the run from a foster home.
He invited her home and they ended up having sex.
The report states that under Swedish law, having intercourse with someone under the age of 15 is ‘child rape’.
However, the law also states that a defendant must “know” or have “reasonable grounds to believe” that the child is under age, both of which was ruled not possible on the grounds that the 13-year-old’s body was very “well-developed”.
Sweden’s social media went into a frenzy after the ruling and the girl's lawyer Göran Landerdahl told the TT news agency that he planned to take the case to Sweden’s Supreme Court.
