The 39-year-old businessman - who was engaged to Sofia until last year - is locked in a bitter dispute with the 'Modern Family' actress over the couple's frozen embryos and in his legal complaint against the 42-year-old star, Nick has claimed she was abusive towards him.

Nick appeared on the 'Today' show to put his side of the story across, and co-host Hoda Kotb read from his complaint, saying: "She physically abused him on four separate occasions, she punched him in the face on two occasions, kicked him and threw her phone at his head.

"She also routinely bullied him, called him a loser, worthless and other degrading names."

During the show, Nick was asked if he wanted to have "a baby" or "her baby", and he replied: "It has nothing to do with her baby or a baby. Lives were already created. A lot of the questions are 'Why don't you move on and meet somebody else?'

"No doubt I would love to do that, but doesn't it matter that two lives have already been created and I wouldn't just toss aside a child that had been born."

She said: "I don't think its fair.

"I don't want to allow this person to take more advantage of my career and try to promote himself and get press for this."

And the 'Modern Family' star - who has 22-year-old son Manolo from a previous relationship and is now engaged to Joe Manganiello - thinks Nick has created "something ugly out of nothing" with his lawsuit, which was filed in August 2014, because they already had a signed document stating "no unilateral action" could be taken with the embryos unless they both agreed.

She told 'Good Morning America': "It shouldn't be out there for people to give their opinion when there's nothing to talk about.

"There's papers signed. There is a court date.

"He shouldn't be creating something so ugly out of nothing."

Meanwhile, Nick insists he isn't responsible for the leaking of the dispute.

He told 'Today': "Unfortunately, I didn't even come out with the story to begin with. It was leaked to press, there was comments made by her team in the press, and I felt I needed to come out and correct the record."
