The Federal Supreme Court has referred the case of a couple accused of murdering their maid and hiding evidence back to the Court of Appeal.
The couple was acquitted of the charges by the Criminal Court and the decision was later upheld by the Court of Appeal. However, the prosecution appealed to the Federal Supreme Court against the acquittal, which the court heeded.
'Emarat Al Youm' has reported that the prosecution is seeking maximum punishment against the couple and has gathered all the forensic evidence that point to a criminal act of murder.
When the battered body of the maid was found by the police at the feet of an apartment building in a Northern Emirate, it was seen as a case of suicide.
However, following extensive investigations the prosecution ruled out the suicide theory.
The public Prosecution accused the maid’s employers of intentionally kill her after a fight occurred between them, following which they threw the body from the window of the apartment, to mislead the judiciary and hide the evidence of the crime.
The prosecution pointed out that the forensic report proved that the death was a criminal act and resulted from suffocation by pressing on the chest with a heavy body, which also led to the breaking nine rib bones.
The report says that the blood found on the cylinder and the refrigerator handle inside the apartment is the blood of the victim.
According to the prosecutor the husband admitted during the investigations that his wife had already beaten the maid, and that nobody else entered the apartment, and that the injuries described in the forensic report resulted from a fight.
The Federal Supreme Court has ordered a retrial asking the Court of Appeal to reconsider the case in the light of the evidence provided by the Public Prosecutor.
