Engineer to pay Dh200k 'diya' to each worker who burned to death
The Federal Supreme Court has refused an appeal from an engineer against the judgment of the Court of Appeals directing him to pay ‘diya’ (blood money) to two workers who burned to death at a work site, Emarat Al Youm reports.
The engineer was accused of negligence and not taking the necessary precautions at the work site, which led to the death of the two, and another getting injured.
The court confirmed that the defendant is responsible for security and safety and by his/ her fault caused the death of the victims.
Public Prosecution referred the accused to a criminal trial on the charge of negligence and not taking the necessary safety and security measures.
The court ruled that due to negligence and violation of laws and regulations, the accused didn’t check that the electric current was disconnected, before starting work.
The court pointed out that this resulted in the death of the victims who were burned to death ,and the injury of another person.
The Court of First Instance ruled that the accused be fined Dh3,000. The Appeals Court ruled that a diya payment of Dh200,000 be made to the heirs of each dead person.
The accused appealed against this ruling.
