Sacked worker can keep house till he gets benefits

A worker sacked by his private sector employer can keep the house provided by the company until receiving all end of service benefits. In case the worker is evicted before that time, the employer must pay compensation.

The Federal Supreme Court reached that conclusion during a case filed by a sacked public relations employee against his firm demanding compensation for arbitrary termination of services, housing and other allowances.

The employee said he had worked for that company between 1997 and 2007 and that it must compensate him for its measures against him, including the eviction from his house and delayed salaries.

The company filed a counter complaint demanding the employee to pay Dh166,000 that includes a loan and interest on the loan received by that employee during his service.

A court of first instance ordered the company to pay him Dh94,000 but he appealed the sentence at another court, which increased the sum to Dh233,000. The employee then resorted to the Supreme Court on the grounds that sum did not include housing compensation.

“The Supreme Court added Dh89,000 in housing compensation for the employee to that sum,” 'Emarat Al Youm' daily said.

“It based its sentence on the fact that a sacked worker has the right to stay in the accommodation provided by the employer pays him all his dues, including end of service benefits and housing allowances. The worker can give up the accommodation once the employer deposits all those benefits and allowances with the Ministry of Labour.”
