Employees falling ill during their annual holiday should have their sick leave deducted from that holiday provided they prove they were ill during that period, according to the UAE’s top Islamic authority.

The Fatwa (Islamic edict) and Legislation Department at the Ministry of Justice was responding to a query by the General Information Authority about one of its female employees who produced a medical report showing she fell ill while on her annual holiday, according to 'Al Khaleej' newspaper.

The Department cited Decision 13 issued by the federation cabinet in 2010 ruling that a sick leave is not included in the employee’s annual holiday.

“This means that the sick leave must be deducted from the annual holiday period and considered only as a sick leave provided the employee produce a medical report containing a sick leave,” it said.
