Dubai Traffic Court on Tuesday ordered a GCC woman and an Asian widower to pay Dh420,000 blood money in the case involving a foetus and deceased mom.

While the 37-year-old woman motorist is required to pay Dh252,000 in blood money to the deceased woman, her unborn child and her daughter, the widower is ordered to pay Dh168,000 to the heirs of his deceased wife.

The court also ordered the suspension of the woman driver’s licence for three months and asked her to pay a fine of Dh10,000. The man’s licence also stands suspended for three months, while the court ordered him to pay Dh6,000 in fine.

The accident happened in December 2005 on Emirates Road, when the two cars collided killing the man’s then five-month pregnant wife and his daughter. The girls in the GCC woman’s cars sustained minor injuries.

Investigations by Traffic Prosecution and police reveal that the woman is 60 per cent liable while the man is 40 per cent liable for the accident. He was driving at a speed less than the minimum speed limit of 60km/hr, while the woman was recklessly driving above the 120km/hr speed limit.

Head of Dubai Traffic Prosecution, Salah Bu Farousha Al Felaasi, said this is the second-of-its-kind ruling in Dubai, whereby motorists are ordered to pay blood money to the heirs of a foetus.

He called upon motorists to be vigilant while driving and to abide by traffic rules.
