Court affirms indictment of Plinky’s ex-hubby on domestic abuse

MANILA She stood up against domestic abuse, reemerged as a stronger and better individual, and moved on with her life.

And now the actress and Pilates expert Plinky Recto has good reason to open another bottle of champagne even when the Yuletide Season is over.

Sources from the judiciary indicated over the weekend that the Court of Appeals (CA) has affirmed the indictment of Magdaleno Peña, mayor of Pulupandan town, in the central Philippine province of Negros Occidental, on a complaint of abuse filed by his estranged partner, Ms Recto.

She is now happy taking care of her son by Mr Peña and teaching Pilates to housewives, athletes, and the handicapped. In earlier interviews she had told journalists that she’d learned a great deal from her life with her ex-hubby, and that she has since become a better person in dealing with personal problems.

After studying various dance forms like ballet and jazz in the United States, Ms Recto came back to the Philippines in the ‘70s and embarked on a show-business career, hosting some TV shows, such as the most popular noontime variety show, ‘Eat Bulaga!’ Then she did some movies later on, mostly in the comedy genre.

Born Marie Roxanne Recto, the actress, who is a granddaughter of the country’s great hero Claro M Recto and sister of Senator Ralph Recto, also won custody of her eight-year-old son with Peña in 2011.

The petition was granted by a CA division different from that which affirmed the indictment of Mr Peña on domestic abuse.

CA’s Associate Justice Eduardo Peralta, Jr affirmed a resolution written by the Department of Justice (DoJ) that found Peña liable for violation of Republic Act No 9262, otherwise known as the Anti-Violence Against Women and Children Act.

In his decision, Mr Peralta said the DoJ did not abuse its power when it ordered the filing of a criminal case against the mayor, based on a recommendation by Assistant State Prosecutor Hazel Valdez.

The court took note of Mr Peña’s admission that he had pushed Ms Recto twice and trapped her with a rattan chair when they were still living together in a condominium in Mandaluyong City, a Metro Manila suburb.

Earlier, the Supreme Court disbarred Mr Peña, who had accused then Justice Maria Lourdes Sereno (now chief justice) and Senior Justice Antonio Carpio of falsification of documents in a collection case the mayor instituted. The accusation turned out to be just that—accusation.
