Supreme court hands custody of son to mother

In a custody battle that has stormed through the every level of the courts, the Apex court in its final verdict ruled that the son would be with his mother until he is an adult.

The father was seeking the custody of the boy, while the girls, who are younger, were already given in the mother’s custody, Emarat Al Youm reported.

The Court confirmed in its verdict that the law grants the court power to extend the duration of the incubation of the male child until he is adult if it is in his interest.

The court observed that the boy living with the mother and sisters will form a strong bond with them, which is good for the future. The three children Khalid, Nouf and Maha have been the centre of a dispute since their mother filed a lawsuit before the court of personal status.

The mother sought their custody and asked the court to order the children’s father to pay for the children’s expense.

However, the Court of First Instance granted the mother custody of her two daughters Maha and Nouf only and asked the father to pay an alimony of Dh5,000 per month including housing, clothing and food from the date of filing the lawsuit.

The mother didn’t accept the verdict of the court of first instance and challenged it before the court of appeal which granted her the custody of her son, Khaled, till he becomes an adult, along with the two daughters.

The Court also ordered the father to pay Dh1,000 per month for each of the three children, including the expense of food, drink and clothing in addition to the amount of Dh2,500 as housing rent.

The Court of Appeal upheld the ruling of the lower court, refusing the request of the mother to assign a servant for her and her children.

The father appealed the verdict before the Federal Supreme Court which upheld the ruling.
