Fatwa: Divorce SMS sent in anger is invalid

An SMS message sent by a husband to his wife containing the word ‘divorce’ is enough to make the divorce valid, according to a fatwa of Dubai’s Department of Islamic Affairs and Charitable Activities.

A report in the Arabic newspaper ‘Al Ittihad’ said the fatwa came in response to an enquiry by man who wanted to know whether the SMS message he had sent to his wife telling her that he was divorcing her, is valid according to the Shariah or Islamic law.

The woman had left him and gone to her father’s house after a quarrel with her husband. The man then went to her father’s house and told her that he had divorced her.

Another fight then took place during which he again told his wife that he was divorcing her. Then he sent an SMS text informing her that he was divorcing her, bringing the total to three, as required by the Shariah.

An Islamic scholar ruled that, though a declaration of divorce in anger in not valid, however, in other cases an SMS message is valid.
