Lohan: 'I'm the real victim in rehab battery case'

UPDATE: Actress Lindsay Lohan now claims she was actually the victim in a battery case brought against her concerning an incident at the Betty Ford rehab clinic earlier this month.

Lohan says Dawn Holland, the Betty Ford staffer who now claims she's the victim of battery was so abusive she made her cry. She disputes Holland's story that Lohan attacked her and caused her to sprain her arm so severely she's on workers' compensation. 

Lohan is telling her friends and family, when she returned to the house, Holland grabbed her abruptly and pushed her so hard, she began to cry. She has reportedly said that's when she went inside the house and called 911, TMZ.com reports.

As for refusing to take a breathalyzer, Lohan said she actually asked Holland to give her a test but Holland refused. The actress claimed there were not only witnesses that saw everything ... there are surveillance cameras to prove her story.

EARLIER: The Betty Ford staffer who accused Lindsay Lohan of assault has lost her job for breaking confidentiality rules.

Dawn Holland was fired by the Betty Ford Clinic on Tuesday after she spoke to TMZ about the Lindsay Lohan situation, according to reports. 

In a statement, clinic officials said: "Regrettably, on December 21, 2010, one of our employees violated strict confidentiality guidelines and laws by publicly identifying patients in a media interview and by disclosing a privileged document. The employee has been terminated by the Betty Ford Center."

Lohan, whose promising career has been buried by legal and drug problems, is now under criminal investigation as a result of a late-night confrontation at the Betty Ford rehab center in southern California, an official said on Tuesday.

Riverside County Deputy Sheriff Herlinda Valenzuela said police were called to the facility in the early hours of December 12 and conducted a misdemeanor battery investigation involving Lohan and an unidentified member of the centre's staff. "The victim desires prosecution," Valenzuela said, but she added that detectives have not yet completed their investigation. No further details were available.

But Holland, a chemical dependency technician, hasn't let that stop her. Almost immediately after she was canned, she opened up on the dirty details in an interview to TMZ.com, allegedly getting paid $10,000 for the information.

The former staffer claims when Lindsay Lohan came home ten minutes past curfew, Holland was asked to perform a field sobriety test -- she says she could smell alcohol on Lindsay's breath at the time. Lohan then reportedly called her mother, Dina, who said she didn't have to submit, and then threw a phone at Holland, proceeding to accuse her of being a money-grubber when Holland threatened to press charges.

Lohan says Holland berated and pushed her first and that she was merely defending herself. As for Lohan's claim Holland touched her first, she says, "I did not touch the woman."

Lohan's estranged father, Michael Lohan, told rival outlet X17 that her daughter returned late from a hair appointment, and that the woman grabbed her arm.

Jail possible again

Whatever the truth of the matter, Holland had broken very strict confidentiality rules in place in every rehab centre in the world, even going so far as to reveal the psuedonym Lohan goes by in the treatment centre.

Police are investigating the entire situation. If Lindsay Lohan is arrested, she could go to jail for six months on a parole violation. As for Holland, it's probably a safe bet she'll never work in a treatment facility every again. In the meantime, Holland has found herself a lawyer.

Lohan, 24, voluntarily checked into the Rancho Mirage, California-based clinic in October, after failing a random drug test linked to her probation on a 2007 drunk driving charge. She has already spent about two weeks in jail and three weeks in another rehab center this year.

Abuser

But the accuser isn't all lily-white herself. It has emerged that Holland was embroiled in a bitter divorce last year. Her husband claimed she accused him of cheating and one day, "She got out of bed.  She hit me," TMZ.com reported. In another incident in 2008, Holland's husband claims she "lost control, broke up a lot of my personal property and attacked me, kicking me in the leg and causing a contusion."

For her part, Holland claims her husband viciously attacked her on several occasions. Holland -- who is now divorced -- has a restraining order against her ex-husband, but his petition for one was denied.
