Abu Dhabi hospital gets doctor's bill for brain damage at child-birth: Dh1.3 million

A doctor and a private hospital in Abu Dhabi will jointly pay Dh1.3 million in compensation to the legal guardian of a child, who sustained brain damage due to a medical error committed by the gynaecologist doctor at the time of the childbirth, the Abu Dhabi Court of Appeal has ruled.

Upholding the trial court judgment, the higher court also ordered to award Dh50,000 in damages to the mother of the child for injuries caused by a delay in delivery as well as her life long ordeal in bringing up a differently ables child.

The Appellate Court rejected part of the lower court verdict which had dismissed a claim for the award of Dh50,000 in compensation to the father of the child for the mental agony he has to suffer due to the brain damage of his offspring.

While the civil claim by the parents of the child for an amount of Dh5 million was pending decision, the court referred the case to the Higher Committee for Medical Liability, which in turn confirmed the medical error.
