Court cancels Abed Al Boom's bail

The Dubai Criminal Court cancelled the bail of Abed Al Boom as it was proved he did not pay $20 million into the account of the Judicial Committee assigned to settle his financial status.

The decision was taken after checking with the Judicial Committee whether Al Boom has made the deposit into its account or not. Since the amount was not paid, the court made its decision.

Ali Al Falasi, one of the accused’s lawyers, had submitted to the court at the June 27 hearing a document addressed to a local bank from a company stating that the firm will deposit within 96 hours in its account $20m with an order for the bank to transfer the amount to the committee’s account.

The court at the last hearing had adjourned the case to Sunday to check whether the amount was deposited with the Emirates Islamic Bank specified by the defence lawyers to show goodwill of the accused and his capability to refund the money in his custody.

Emirates Islamic Bank was supposed to transfer the money to the Judicial Committee’s account.

As this did not happen and in order to avoid the court’s latest decision, the accused’s defence lawyer Hassan Al Raissi had told the court that Al Boom has no tendency to run away as he and all the other accused had been attending the hearings since one year.

The court had ordered a Dh500,000 fine should the accused fail to attend a hearing. Besides five passports, some of which are of Al Boom’s family, in the court’s custody.

The lawyer told the jury that there is no legal cause for the cancellation of the bail that is usually ordered in case it is anticipated that an accused will try to skip or to avoid negative impact on legal procedures.

As per the prosecution sheet Al Boom is facing complaints of embezzlement filed against him by 3,700 for Dh1 billion claims. Due to the special nature of the case due to such a large number of complainants the court has been ordered to hear the case in private sessions and settle it quickly.

The court, however, made its decision and adjourned the case until October and ordered the public prosecution to quickly execute the decision.
