Court demands Chechen case waiver in original

The defence lawyer of the Iranian clerk, the prime accused in the assassination case of Chechen leader Sulim Yamadayev, submitted a copy of the concession of the blood guardians of the victim.

Yamadayev was assassinated on March 28, 2009, in the parking lot of his home at Jumeirah Beach Residence.

The Dubai Court of Appeal adjourned the case until December 8 for the accused MT’s lawyer Abdullah Al Madani to submit the original concession with an Arabic translation attested as per the rules and formalities.

In a dramatic development in a previous hearing, MT’s defence lawyer told the Appeal Court that the blood guardians have agreed to make a concession of their right.

MT and MK, Tajik businessman, were accused along with other fugitives of the assassination of Yamadayev to the favour a Chechen politician. He had come to reside in Dubai four months before his assassination.

According to the prosecution sheet, two people used to accompany Yamadayev as personal guards. One of them was hit on his head by the killers and the other one was never attacked.

MT’s role was to control Yamadayev, and he was accused of criminal complicity and possessing unlicensed weapon used in the crime, which was found next to the body.

MK was also accused of criminal complicity.

Each of the accused was awarded life terms followed by deportation and the confiscation of the weapon by the First Instance Court on April 12.

Both the Dubai Public Prosecution and the defendants have appealed the First Instance Court’s sentence.
