The Dubai Criminal Court heard the case of an Emirati policeman allegedly forcing a minor girl (age below 14 years) to have sex with him.

HA, 35, the mother of the victim KAH, had left her daughter at a relative’s house after she paid them condolences. The two daughters of the family, Samia and Muneera, asked her to let KAH stay back with them.

The mother allowed her daughter to stay at the relative’s house. After a couple of days the daughter came back home and locked herself in the bedroom for three days.

The mother used a spare key and opened the door. “She was lying on her bed and was crying. When I asked her why she was crying, I did not receive any answer,” the mother testified before the Prosecution.

"On the same day, Samia and Muneera came to our house and requested to take my daughter with them and I gave my permission. After they left, the housemaid told me that when my daughter had arrived from the relative’s house she had asked her (the maid) to wash her clothes and it was stained with blood.”

The maid had asked the girl why her clothes were stained, but did not receive an answer.

“But today when Samia and Muneera came, she told me that rode in Samia’s friend’s car and he had sex with her and violated her virginity,” the maid told the mother, adding that the girl had asked her (the maid) to tell the mother only after she left the house.

The mother called her daughter and asked her to come back home and immediately took her to a gynaecologist who confirmed that the girl was no longer a virgin and that she was subject to a sexual intercourse.

The daughter was scared to tell her mother anything about the incident, so the mother asked her daughter to call Samia and to keep the phone in the speaker mode. The mother asked her daughter to tell Samia the she (the mother) knew about the issue and to ask her for the man’s mobile number.

Once the mother got the mobile number from Samia, she called the man who denied having sex with her daughter.

The girl, then, told her mother that she had gone to a saloon with Samia and the latter's boyfriend had arrived and threatened her to get into the car with him. "so I rode the car, which he stopped next to Al Twar park and then he forced me to have sex and violated my virginity," the girl told the mother according to the latter's testimony in court.

The mother told the father and the two decided to notify police after taking the advice of the Dubai Charity Establishment for Woman and Child Care. The mother lodged a complaint at the Al Rashidiya Police Station.

Asia Nasan, the Indonesian maid testified that on May 8, that the victim had asked her to wash her clothes and she saw blood stains on the underwear and upon asking the girl she did not receive any answer. However, after three days of locking herself in her bedroom, the girl told the maid about the man who had threatened her to get into his car where he had violated her virginity. “The girl was scared so asked me to inform her mother but only after she left with the other girls and so I did,” the maid testified.

Sahar Al Sayed Ahmad, 42, Egyptian, forensic expert testified before the prosecution that on May 20 she tested the victim and reported that there were no injuries on her body. However, the expert confirmed that the girl was no longer a virgin and since her hymen wound was completely healed she could not specify the details.

The forsenic expert did reveal that the period needed for the hymen wound to cure varies from one woman to another and that the wound could have healed since the day the incident occured as claimed by the victim.

Azza Ali Hafez, 56, Egyptian, gynaecologist testified before the prosecution that she had checked the victim on May 16 and she was suffering from bleeding resulting from her recently violated hymen. The wound was recent and the girl was not menstruating at that time.

She too confirmed that three to seven days is sufficient for a hymen wound to heal.

Forensic report proved that there were sperms on the front right seat of the car of AHM, 21, Emirati, policeman. The DNA found in the car matched with that of the accused, which is saved in the Force data base.

The victim KAH told the Prosecution that Samia had sent the accused an SMS informing him that they were in the saloon in the Al Twar area. The accused arrived and asked her to get into his car. “As I refused he threatened me and told me that he would drag me out from the saloon so I went out of the saloon and got into his car. He drove near Al Twar Park and strongly hugged me and undressed me. I resisted him but he was very heavy and I could not do anything until he violated my virginity. Thereafter, he went to a supermarket and bought tissues and dropped me back at the saloon,” she testified.

The Prosecution filed an indecent assault under duress accusation against MHM.

Despite the forensic report, which proved the presence of his sperms on the front seat, the accused denied having sex with any woman or masturbating in his car.

The Court has adjourned the case till next month.
