Dubai Prosecutor puts road assault case on hold

Dubai Public Prosecutor office has announced its decision to put on hold all investigations in the assault case against the Asian driver following the traffic accident that took place earlier this month.

The case attracted attention after a video filming of the incident was posted on social media. The prosecutor’s decision to put the investigation on hold came pursuant to the plaintiff’s choice to waive his rights in the case. Moreover, the defendant’s family waived their rights in the torts claim against the third party who filmed the case.
 
Dubai Public Prosecutor Essam Al Humaidan stated that the case is closed following the second and third parties’ waiver of their rights. He asserted that the investigation authorities initiated all legal actions relevant to the crime to guarantee all parties’ rights pursuant to applicable laws.
 
Al Humaidan stressed the importance of increasing awareness regarding some practices that could form violations of the law and, in consequence, moral or tangible damages. The Dubai Public Prosecutor clarified that bad individual behaviour or misconduct cannot be generalised as social behaviour, and each individual should carry the consequences of his or her actions.

He emphasised that tolerance and kindness are basic Emirati values, and the UAE community is characterised by its diversity, adding that the UAE community is a unique model for coexistence and harmony under principals of law that do not distinguish between people, and this value of equality is a fundamental pillar of safety and security.
 
The Dubai Prosecutor called on the people of Dubai not to hasten to use any evidence that they may have regarding any legal violations or crimes. He stressed the importance of adhering to correct legal procedure, which is: reporting to the police and submitting to them any evidence that may be relevant to avoid any legal complications despite good faith.
 
The Dubai Public Prosecutor had accused the first defendant of "physical assault" and the second defendant of "posting a video online with intent to cause damage".
 
The Public Prosecutor’s office clarified that pursuant to Article (20) of the Federal Criminal Procedures Code, the plaintiff in the assault case waived all his rights against the first defendant, therefore the Public Prosecutor may not proceed with charges against the defendant. The defendant’s family also passed over the charges against the second defendant, the person who posted the video online, and accordingly the Prosecutor decided to put on hold the investigations and accept the arrest and initial custody as punishment.

Both defendants have been released.
