Dubai: What do you do if your tenancy contract is coming to an end, and you’re ready to move out of your rented apartment? Or what if you decide to terminate your lease early? Few aspects of renting in Dubai generate as much confusion as the end of the tenancy. Below, we break down the process of Ejari cancellation and the rules around ending a tenancy period in Dubai. What is Ejari? If you are new to the rental market in Dubai, it’s important to get familiar with Ejari. Simply put, it’s the Dubai government’s official online registration system for tenancy agreements, and without it, tenancy contracts are not recognised by government authorities. However, when you need to end a tenancy contract, you must ensure you kickstart the Ejari cancellation process, too. Ejari cancellation is the official process of removing a tenancy contract from the Dubai Land Department (DLD) register after the lease has expired, been terminated, or the property has been vacated. It ensures that the tenancy record is legally closed and that the property is no longer registered under the previous tenant. Through this process, landlords and tenants protect themselves by preventing future disputes or liabilities, and clearing the property for new Ejari registration. Navandeep Matta, senior associate at Kochhar & Co. Inc. Legal Consultants, Dubai, explained: “The critical practical point is that the Ejari record does not lapse of its own accord when the term ends. It remains live on the DLD system until it is actively cancelled. Until then, the landlord cannot register a new tenant against the unit, and the outgoing tenant may find themselves blocked from registering an Ejari elsewhere.” What happens if I don’t cancel Ejari? There are three consequences to not following through on Ejari cancellation, according to Matta: Utility account linkage: The final Dubai Electricity and Water Authority (DEWA) utility account closure and deposit refund, as well as the clearance from the district cooling provider, are tied to the tenancy record. Inaccurate address on file: Your live Ejari record is linked to your family residence sponsorship, school admission files, telecommunication accounts, and trade licences addresses. This means, if you have left the residence without cancelling Ejari, all the listed addresses on these files would be inaccurate. Risk of tacit renewal: Matta said: “Under Article 6, where the term expires and the tenant continues to occupy the property without objection from the landlord, the contract is deemed renewed on the same terms for the same period or for one year, whichever is shorter. A tenant who has neither vacated cleanly nor documented the non-renewal may face a claim for a further year of rent.” What if I want to end my tenancy contract early? Early termination of a tenancy contract is possible under Dubai law, but it is not an automatic right. Article 7 of Law No. (26) of 2007 Regulating the Relationship Between Landlords and Tenants in the Emirate of Dubai establishes that neither party may unilaterally terminate or amend the contract without the other party’s consent. Matta explained: “The contract therefore governs, and the outcome depends almost entirely on what was agreed at the outset.” Most leases address the issue of tenant-initiated early exit in the ‘Additional Terms’ annexure to the DLD Unified Tenancy Contract. In Dubai, terminating a tenancy contract before its expiry date carries a standard penalty of two months’ rent, together with 60 days’ prior written notice, according to Matta. If the contract is silent on the issue, the tenant remains (in principle) liable for the rent for the unexpired portion of the term, and the landlord may present the remaining cheques. Matta said: “Ask for an express early termination clause with a defined notice period, compensation capped at a fixed number of months, and wording confirming that no further liability survives once the cheques are returned.” Serve notice in a provable form, following the method stipulated in the contract: Matta said: “For a significant tenancy, mirror the Article 25 standard of notice through a notary public or by registered mail.
